21 December 2020, Budapest – The Hungarian Competition Authority (GVH) has initiated a proceeding against DIGI since their promotion on the high-speed internet service may be misleading for consumers.

         The GVH has initiated a competition supervision proceeding in order to investigate whether DIGI Távközlési és Szolgáltató Kft. (DIGI) provided consumers with sufficient information when promoting its “DIGINet 1000” service. The undertaking allegedly creates the impression that consumers can achieve the offered (or at least the guaranteed) internet speed by purchasing a subscription to the FTTH fibre optic service without having to fulfil any further conditions. However, to reach these speeds, the own devices of the consumers shall also meet specific technical requirements and if they are accessing the internet by using wireless devices, a router that is able to provide the offered speed has to be purchased additionally. Therefore, the undertaking is presumably not or not in time providing consumers with important information necessary for making their purchase decisions.

         The initiation of the competition supervision proceeding does not mean that the undertaking has in fact committed the suspected infringement. The proceeding is aimed at clarifying the facts and thereby proving the alleged infringement. The time limit for the completion of the proceeding is three months which, where justified, may be extended on two occasions by a maximum of two months each.
