Decision of the Competition Council of the Hungarian Competition Authority (Gazdasági Versenyhivatal - GVH) Vj-20/2005 and Vj-97/2006: SAP Hungary Kft., Synergon Rt.

The Competition Council of the Hungarian Competition Authority (Gazdasági Versenyhivatal - GVH) established in two separate decisions (Vj-20/2005 and Vj-97/2006), issued on 20 September 2006, that SAP Hungary Kft. and Synergon Rt., undertakings active in the IT sector, infringed the provisions on the prohibition of agreements restricting economic competition of the Hungarian Competition Act.

In the competition supervision proceedings the Competition Council of the GVH found that SAP Hungary Kft. and Synergon Rt. concluded an agreement in order to influence the outcome of the public bid published by the local government of the city of Győr as well as the public bid published by Paksi Atomerőmű Rt. (Paks Nuclear Power Plant). The behaviour of these undertakings is considered as one of the most severe infringements of competition law.
The Competition Council of the GVH obliged the three undertakings to pay the following fines: SAP Hungary Kft.: HUF 21,8 million (ca. EUR 79600), Synergon Rt.: HUF 21,8 million (ca. EUR 79600).
