The Competition Act empowers the President of the GVH to issue, together with the Chair of the Competition Council, notices, which describe the basic principles of the law enforcement practice of the GVH. Such notices, contrary to legal norms, have no binding force; their function is to state how the law enforcer will apply the legal provisions, summarising past experience of the GVH and outlining the practice to be followed in the future. The notices are based on the experience drawn from the adopted decisions; however, in the abstract, they also reflect the GVH's general approach to competition.

Notices were issued in the following topics so far:

  • Considerations in differentiating between concentrations subject to authorisation in simplified or full procedure;

  • The application of a leniency policy to promote the detection of cartels.
